New practice: Transmitting Certified Canada Agricultural Review Tribunal Records to the Federal Court of Appeal

The Canada Agricultural Review Tribunal (Tribunal) will no longer send certified copies of all materials in its possession that are relevant to an application for judicial review (i.e. a certified tribunal record) to the Federal Court of Appeal and the party making the request unless the requested materials are not in the possession of the party making the request.

When the Tribunal is notified of an application for judicial review, it will provide to the parties a list of the relevant materials in the Tribunal's possession and any materials that have not already been shared, such as the recording of the hearing. This will help the parties identify which materials they do not already have.

This change in practice is to ensure compliance with Rule 317 of the Federal Court Rules.
